Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the services, programs, website, communications, and related offerings provided by Maple Horizon Learning Centre (“Maple Horizon,” “we,” “us,” or “our”), located at 2450 Yonge Street, Toronto, ON M4P 2H5, Canada.

By enrolling in, accessing, purchasing, or otherwise using our services, or by permitting a student to participate in our programs, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

If the student is under the age of majority in Ontario, a parent or legal guardian must accept these Terms on the student’s behalf and is responsible for the student’s compliance with them.

2. Scope of Services

Maple Horizon provides educational and academic support services, which may include, without limitation:

  • Elementary and middle school education;
  • After-school tutoring support;
  • Homework help and study skills coaching;
  • English language learning support; and
  • Math and science enrichment programs.

Services may be delivered in person, online, or in a hybrid format, depending on program availability and operational requirements. We may modify, suspend, or discontinue any service, class, instructor assignment, schedule, curriculum component, or delivery method at any time, subject to applicable law and any written enrollment agreement.

Unless expressly stated otherwise, Maple Horizon does not guarantee specific academic outcomes, grades, test results, admission outcomes, language proficiency levels, or other performance metrics.

3. User Obligations and Responsibilities

By using our services, you agree that you will:

  • Provide accurate, current, and complete registration, medical, emergency contact, and billing information;
  • Promptly update us regarding any changes to such information;
  • Ensure that the student attends sessions on time and is prepared with required materials;
  • Comply with all attendance, conduct, safety, and pickup/drop-off procedures communicated by Maple Horizon;
  • Respect staff, instructors, students, property, and facilities;
  • Not engage in disruptive, abusive, discriminatory, harassing, fraudulent, or unlawful conduct;
  • Not record, reproduce, distribute, or publicly share classes or materials without our prior written consent, except as permitted by law;
  • Supervise minors as required outside of program hours and ensure timely pickup where applicable; and
  • Comply with all applicable federal, provincial, and municipal laws and regulations.

We reserve the right to suspend or terminate access to services if a student, parent, guardian, or other user engages in conduct that we reasonably determine to be unsafe, disruptive, unlawful, or inconsistent with our policies or the best interests of students and staff.

Parents and guardians are responsible for informing us of any relevant medical conditions, allergies, learning needs, accessibility requirements, behavioral considerations, custody restrictions, or other information necessary to support the student safely and appropriately.

4. Payment Terms and Conditions

Fees for services, registration, materials, assessments, and any other charges will be communicated at the time of enrollment or through a written fee schedule. Unless otherwise stated, all fees are in Canadian dollars (CAD).

  • Payment is due in accordance with the billing cycle, invoice, or enrollment agreement provided by Maple Horizon.
  • We may require advance payment, deposits, or automatic recurring payments for certain programs.
  • Late or failed payments may result in suspension of services, late fees, administrative charges, or loss of reserved placement, to the extent permitted by law and disclosed in advance.
  • You are responsible for any bank charges, chargeback fees, or collection costs incurred due to non-payment or disputed payment not made in good faith.
  • Any taxes applicable under Canadian law, including HST/GST where applicable, will be added to the stated fees unless expressly included.

Fees are generally non-transferable unless we agree otherwise in writing. Promotional pricing, discounts, or scholarships, if offered, may be subject to additional conditions and may be withdrawn or modified at our discretion, subject to applicable law and any written commitment.

5. Cancellation and Refund Policy

Cancellation, withdrawal, make-up class, and refund rules may vary by program and will be set out in the applicable enrollment materials, invoice, or written policy. If there is any inconsistency, the specific program policy will apply to the extent permitted by law.

  • Notice of cancellation or withdrawal must be provided in writing to [email protected] or by another method we designate.
  • Refund eligibility may depend on the timing of cancellation, the nature of the service, whether services have already commenced, and whether materials or administrative costs have been incurred.
  • Where a refund is approved, it will be processed using the original payment method where practicable, less any non-refundable fees or permitted deductions.
  • Missed classes, late arrivals, early departures, or absences due to personal scheduling conflicts are generally not refundable unless otherwise stated in writing or required by law.
  • We may cancel or reschedule classes due to low enrollment, instructor unavailability, safety concerns, weather, public health directives, or other operational reasons. In such cases, we may offer a make-up class, credit, transfer, or refund, as appropriate and subject to applicable law.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws in Ontario or elsewhere in Canada that cannot be waived by agreement.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Horizon, its directors, officers, employees, contractors, instructors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of opportunity, or reputational harm, arising out of or related to the use of our services.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services or these Terms shall not exceed the amount paid by you to Maple Horizon for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to liability, or CAD $100, whichever is greater, except where such limitation is prohibited by law.

We do not exclude or limit liability where such exclusion or limitation would be unlawful, including liability for gross negligence, wilful misconduct, or any other liability that cannot be excluded under applicable law.

Educational services involve inherent judgment, participation, and individual effort. We are not responsible for outcomes affected by student attendance, effort, prior academic standing, third-party school policies, or external circumstances beyond our reasonable control.

7. Intellectual Property Rights

All curriculum materials, lesson plans, worksheets, handouts, assessments, presentations, logos, trademarks, designs, text, graphics, videos, audio, software, and other content provided by Maple Horizon are owned by or licensed to Maple Horizon and are protected by applicable intellectual property laws in Canada and internationally.

  • You may use our materials solely for personal, non-commercial educational purposes in connection with the enrolled student’s participation in our services.
  • You may not copy, reproduce, distribute, modify, publish, sell, sublicense, or create derivative works from our materials without our prior written consent, except as permitted by law.
  • Any feedback, suggestions, or ideas you submit to us may be used by Maple Horizon without restriction or compensation, unless otherwise agreed in writing.

Third-party materials used in our programs remain the property of their respective owners and may be subject to separate terms and conditions.

8. Data Protection and Privacy

Maple Horizon collects, uses, stores, and discloses personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.

We may collect personal information such as student and parent/guardian names, contact details, emergency contacts, academic information, attendance records, payment information, health or accessibility information where necessary and with appropriate consent, and communications related to our services.

We use personal information to:

  • Provide and administer educational services;
  • Communicate with parents, guardians, and students;
  • Process payments and maintain records;
  • Support student safety, learning needs, and program administration;
  • Meet legal, regulatory, tax, and reporting obligations; and
  • Improve our services and operations.

We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Where required, we may obtain consent for the collection, use, or disclosure of personal information, including for minors. We may disclose personal information to service providers, payment processors, instructors, regulators, emergency responders, or other third parties where necessary to provide services, comply with law, or protect health and safety.

9. Force Majeure

Maple Horizon shall not be liable for any delay, interruption, suspension, or failure to perform its obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, severe weather, fire, flood, power outages, epidemics, pandemics, public health emergencies, labour disputes, government actions, war, terrorism, civil unrest, transportation disruptions, or failures of third-party systems or services.

In the event of force majeure, we may reasonably modify schedules, delivery methods, staffing, or program operations, and may provide make-up sessions, credits, or other accommodations where appropriate and feasible.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our services, legal requirements, operational practices, or other circumstances. The updated Terms will be effective upon posting or upon notice to you, as applicable.

Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the services and, where applicable, withdraw from the program in accordance with our cancellation policy.

11. Applicable Law and Jurisdiction

These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or your use of the services shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any mandatory consumer protection or other applicable laws, the parties attorn to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada for the resolution of any dispute arising from or relating to these Terms or the services.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be deemed modified to the minimum extent necessary to achieve such validity and enforceability, consistent with the original intent of the provision.

These Terms constitute the entire agreement between you and Maple Horizon with respect to the subject matter herein and supersede any prior or contemporaneous understandings, communications, or agreements, whether oral or written, except where a separate written enrollment agreement expressly states otherwise.
